This Privacy Policy explains how Mishkat, Inc. (“Mishkat,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit, use, make a purchase from, or otherwise interact with The Premium Basket U.S. website, our customer-service channels, and related U.S. services (collectively, the “Services”).

The Premium Basket (“TPB”) is a brand and trademark owned by Zi Jibla Ventures Private Limited (“Zi Jibla”). Mishkat, Inc. is authorized to use the TPB brand in connection with its U.S. sales and distribution operations. This Privacy Policy applies to personal information handled by Mishkat in connection with the Services. It does not, by itself, govern independent processing by Zi Jibla or other third parties.

1. INFORMATION WE COLLECT

Depending on how you interact with the Services, we may collect:

  • Contact information, such as your name, email address, telephone number, billing address, shipping address, and other information you provide.
  • Order and transaction information, such as products ordered, order history, delivery details, returns, refunds, discounts, and transaction-related records.
  • Payment-related information. Payments may be processed by third-party payment processors. We generally do not receive or store complete payment-card numbers; we may receive transaction identifiers, payment status, card type, and limited payment information.
  • Account information, if customer accounts are offered, such as login credentials, preferences, saved addresses, and account activity.
  • Customer-service communications, including emails, messages, calls, feedback, reviews, complaints, and information you submit when requesting assistance.
  • Device and usage information, such as IP address, browser type, device type, operating system, referring URLs, pages viewed, interactions with the Services, and approximate location inferred from IP address.
  • Cookie and similar-technology information used for essential site functions, preferences, analytics, fraud prevention, advertising, and measurement, subject to applicable law and the choices made available to you.
  • Marketing information, including your marketing preferences and interactions with marketing communications.
  • Information from service providers and business partners, such as e-commerce, payment, fulfillment, shipping, analytics, fraud-prevention, customer-service, and advertising providers.

We do not intend to collect sensitive personal information unless it is reasonably necessary for a transaction, required by law, or voluntarily provided by you.

2. HOW WE USE PERSONAL INFORMATION

We may use personal information to:

  • provide and operate the Services;
  • process, fulfill, ship, deliver, cancel, return, and refund orders;
  • communicate about orders, deliveries, account matters, customer-service requests, recalls, or safety notices;
  • authenticate users and maintain account security;

  • maintain and improve our website, products, operations, customer experience, and marketing;

3. COOKIES AND SIMILAR TECHNOLOGIES

We and our service providers may use cookies, pixels, tags, software development kits, local storage, and similar technologies. Some are necessary for the Services to function. Others may support analytics, personalization, advertising, or measurement.

Where required, we will provide mechanisms to manage non-essential cookies or other legally recognized privacy choices. Browser settings may also allow you to block or delete cookies, although doing so may affect website functionality.

The treatment of browser-based “Do Not Track” signals varies because there is not a universally adopted technical standard. Where applicable law requires recognition of a legally valid opt-out preference signal, we intend to process such signals as required by that law.

4. HOW WE DISCLOSE PERSONAL INFORMATION

We may disclose personal information to:

  • e-commerce and website-platform providers;
  • payment processors and financial-service providers;
  • fulfillment centers, warehouses, carriers, delivery providers, and logistics partners;

  • Zi Jibla where reasonably necessary for product, manufacturing, quality, regulatory, recall, brand-support, or related operational purposes;

  • parties involved in an actual or proposed merger, financing, acquisition, reorganization, sale of assets, insolvency, or similar corporate transaction; and
  • other parties at your direction or with your consent.

We do not disclose personal information merely because a third party requests it. We may disclose information where reasonably necessary to comply with law, protect rights and safety, enforce agreements, or operate the Services.

5. ADVERTISING AND ANALYTICS

We may use analytics and advertising services that collect information about interactions with the Services. Depending on the technologies used and applicable state law, certain advertising or cross-context behavioral advertising activities may be treated as a “sale,” “sharing,” or “targeted advertising,” even where money is not exchanged for personal information.

Where applicable law gives you an opt-out right, we will provide the required method for exercising that right.

6. MARKETING COMMUNICATIONS

You may unsubscribe from promotional email by using the unsubscribe mechanism included in the message. If SMS marketing is offered, you may follow the opt-out instructions provided in the applicable messages. Transactional or service-related communications, such as order confirmations, delivery updates, safety notices, and customer-service responses, may still be sent where appropriate.

Mobile opt-in information, including phone numbers and SMS consent, will not be shared with third parties for marketing purposes. We use it only to send the messages you asked for.

7. DATA RETENTION

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including providing the Services, maintaining transaction and tax records, resolving disputes, preventing fraud, complying with legal obligations, and enforcing agreements. Retention periods vary depending on the nature of the information and applicable requirements.

8. SECURITY

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No internet transmission, website, database, or storage system can be guaranteed to be completely secure, and we cannot guarantee absolute security.

9. CHILDREN

The Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information online from children under 13 in a manner prohibited by applicable law. If you believe a child has provided personal information to us improperly, please contact us.

10. U.S. STATE PRIVACY RIGHTS

Depending on your state of residence, applicable law, and whether statutory thresholds are met, you may have rights concerning your personal information. These may include rights to request access to or confirmation of processing, correction, deletion, portability, and information about certain disclosures, and rights to opt out of certain targeted advertising, sale, sharing, or profiling activities.

These rights are not absolute and may be subject to exceptions. We may need to verify your identity before processing a request. Where applicable, you may also have a right to appeal our response to a privacy request or use an authorized agent.

To submit a privacy request, contact us using the information in Section 15 and state that your request concerns privacy rights. We will respond as required by applicable law.

11. CALIFORNIA PRIVACY

If and to the extent California privacy laws apply to Mishkat and your information, California residents may have additional rights. We will provide and honor applicable notices, access, correction, deletion, opt-out, limitation, and non-discrimination rights required by law.

Nothing in this section represents that every California privacy statute or provision applies to Mishkat irrespective of statutory applicability thresholds.

12. THIRD-PARTY SERVICES AND LINKS

The Services may contain links to, or integrate with, third-party websites and services. Those third parties may have their own privacy practices and policies. We are not responsible for the privacy practices of independent third parties.

13. INTERNATIONAL PROCESSING

Some service providers, suppliers, or operational partners may process information outside the state or country where you reside, including in connection with TPB product, quality, manufacturing, or support operations. Where required, we take steps designed to handle such transfers in accordance with applicable law.

14. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy periodically to reflect changes in our practices, technologies, legal requirements, or operations. The revised policy will state an updated effective date. Material changes will be communicated when required by applicable law.
